Dutch court rules no tourist visas required for Turks

A Dutch court ruled on Monday that Turkish nationals are exempt from visa requirements during travel to the EU member nation for purposes of tourism just three days after a German court issued a similar ruling.
 

The Haarlem court ruled that Turkish nationals are exempt from visa requirements during travel for tourism purposes of up to three months, upholding an earlier European Court of Justice’s ruling on the highly controversial issue. The court said the visa requirement was in violation of Article 41 of the Additional Protocol to the Association Agreement between Turkey and the European Economic Community (EEC).

Turkish officials have long criticized the EU member state’s slow pace of processing visa applications, high application fees and much higher rate of rejection than that of other EU countries. Turkey and the EU, known as the European Economic Community at the time, signed a protocol titled the Additional Protocol to the Association Agreement between Turkey and the EEC in 1970 that was approved by the EEC in 1972 and which states that EEC states and Turkey will refrain from introducing any new restrictions on the freedom of establishment or the freedom to provide services from the time of the protocol’s entry into force in the signatory countries. Citizens are also allowed to stay in the country for up to three months without having to apply for a residence permit.

If I were to go there without a visa, probably they wouldn´t let me in. The court´s decision has no practical value, I am afraid.{#emotions_dlg.confused}

this court was about a man who was a trader and staying in netherlands without a visa. according to the economic deal made between eu and turkey, turkish bussinessmen are not required to hold a visa to be in netherlands. netherlands asked visa from turkish bussinessmen all this time regardless of this fact until that court.

 

the problem is not about going there without a visa. problem is leaving turkey to go there without a visa. turkish police wont let you leave turkey if youre only turkish and no visa for netherlands. once youre there, from now on, if you are a turkish free trader, you can stay in netherlands for 3 months.

 

the problem however lies in the fact that you cannot prove that youre a free trader in turkey. the only thing a free trader can do is to hand people out free trader recipts for service or goods sold. but im guessing that it wouldnt be too difficult to get a court proof about this and go to airport police and go to netherlands. just havent heard about anyone doing that.
