HUKUK AÇISINDAN POLİSİN HALKA MÜDAHALESİ
“Avrupa İnsan Hakları Mahkemesi uygulamasında polisin bir gösteriyi güç kullanarak dağıtabilmesi için ön şart o gösterinin barışçıl olmamasıdır.
Bizde çok yanlış anlaşılan husus şu. Polis ‘dağılın’ uyarısı yaptıktan sonra göstericiler dağılmazsa, güç kullanmasının meşru olduğu sanılıyor. Oysa barışçıl gösteriye ‘dağılın’ uyarısı yapmak hukuka aykırı olduğu için bu uyarıya uymayana kullanılan güç hangi oranda olursa olsun orantısızdır. Yani barışçıl göstericinin ister kolundan tutsun, ister gaz sıksın orantısız güçtür.
Bir başka ayrıntı toplantı ve gösteri hakkının içine toplantı gösterinin yapılacağı yeri belirleme hakkı da giriyor. Yani barışçıl gösteri yapmak kaydıyla kişiler uygun gördükleri yerde toplantı ve gösteri düzenleyebilirler. Barışçıl davranmak kaydıyla.
‘Yer gösterdik, o yerde yapmadıkları için bu gösteriyi dağıttık’ denilemez. Bu da uygulamada sıklıkla karşılaşılan bir hukuksuzluk.
Hata şurada. AİHS ve AİHM’i, hiçbir şekilde anlamadan genelge yayımlanıyor. Kanunları da AİHM ve AİHS’e uygun okumamız gerekiyor.”

LEGAL ASPECTS OF POLICE INTERVENTION TO STREET PROTESTS
SUMMARY
"European Court of Justice for Human Rights rules that the only allowable case police can use force on protesters is if the protesters are violent.
That police can legally apply force on protesting crowds, when the crowds do not obey the police order to "stop and disperse" a peaceful street demonstration is a gross misinterpretation of the said court´s intentions. Since it is the said court´s uınderstanding that a police order to stop and disperse a peaceful street protest is illegal itself, it follows that any measure of police force applied on peaceful protesters is considered as use of unproportionate force; whether the police grabs one protester´s arm, or soaks him in tear gas are equally illegal.
Another important aspect is that the right of public to exercise peaceful street protests entails also the right to chose the place and time of the planned protest. "We told tham when and where they could have their prostest; when they did not obey, what choice did we have other than forcefully stopping them" can not be a legal excuse for police brutality.
The current Turkish administration must remember their signatures under various EU agreements and act accordingly"
