Gov’t plans to change, not abolish, 301

The government, under pressure from the European Union to change or abolish Article 301 of the Turkish Penal Code (TCK), is planning to introduce amendments to the text of the law while preserving it, but opposition parties are reluctant to let planned amendments go ahead.

Government sources said five amendment proposals, drafted in cooperation with criminal law experts from several universities, were being considered. One common element in the five texts is that they replace the term “Turkishness” in Article 301 with “Turkish nation” and the term “Republic” with “the State of the Republic of Turkey.” This is likely to answer criticism that the terms used in the law are too vague, resulting in court cases for non-violent expressions of opinion.

The proposals also envisage that opening a court case on the basis of Article 301 depend on prior permission, although it is not clear yet who should be authorized to give such permission. One alternative requires authorization from the president, while another calls for the current system to continue, meaning that prosecutors will be free to bring public cases if they secure permission from the Justice Ministry.
The government, on the other hand, has not taken into consideration a different text proposed by several nongovernmental organizations in early 2007, arguing that it is not sufficiently innovative. In the text proposed by the NGOs, the upper limit of a sentence for “insulting Turkishness” had been lowered from three to two years and the sentence reading “In cases where denigration of Turkishness is committed by a Turkish citizen in another country, the punishment shall be increased by one-third” had been deleted. The text had proposed that the same punishment will be applicable irrespective of whether the offense is committed in Turkey or outside of Turkey and that the word “Turkishness” should be construed as “a person who is connected to the Republic of Turkey through the bond of citizenship.”
